2. The present writ petition has been filed by 47 persons working on the post of Assistant Teacher, Senior Basic School/Headmaster, Junior Basic School (both carrying the same pay scale), seeking for quashing of the promotion orders dated 31.7.2015 for granting promotion to the post of Headmaster, Senior Basic School to a total number of 437 persons. Further, prayer is to direct the respondents to redetermine the seniority position of the petitioners herein from the date of their substantive appointment and not from the date of joining on the post of Assistant Teacher, Junior Basic School.
3. The private respondent nos. 5 to 14 are impleaded in representative capacity to represent the promotees, who were granted promotion on the post of Headmaster, Senior Basic School on 31.7.2015.
4. Sri Anup Dhar Dubey and Sri Yogendra Kumar Srivastava learned Advocates appearing on behalf of respondent nos. 8 to 11 and have filed a counter affidavit on their behalf. Respondent no. 5 is represented by Sri Arvind Prabodh Dubey learned Advocate who had filed his Vakalatnama on 15.7.2019.

The facts in brief relevant to decide the controversy at hand are that total 208 candidates were issued appointment letters in District Kushinagar on 25.11.1999 for appointment as Assistant Teacher in Junior Basic School after completion of Special B.T.C. Training Course-1999, after getting certificate dated 25.10.1999 as successful candidates. There is no dispute about the date of issuance of the appointment letters to the petitioners herein, which is 25.11.1999 in case of all the candidates including the petitioners and the respondents herein. It is also admitted that 15 days time was provided to the candidates to join the post of Assistant Teacher in Junior Basic School.
6. The petitioners being teachers working in the schools run by Basic Education Board, their recruitment is governed by the provisions of U.P. Basic Education (Teachers Service) Rules 1981 (hereinafter referred to as “the Rules, 1981”). The appointing authority for all categories of posts under the Rules, 1981 is the Basic Education Officer of the concerned district.
7. In paragraphs ’17’ and ’18’ of the writ petition, it is contended that total 208 candidates had joined on different dates after receipt of the appointment letters dated 25.11.1999. The last batch of the candidates had joined on 10.12.1999. The petitioners herein joined the post of Assistant Teachers in Junior Basic School of District Kushinagar between 3.12.1999 and 7.12.1999.
8. It is stated in paragraph ’19’ of the writ petition that out of total 208 candidates as stated above, only 172 persons including the petitioners herein were in service on the date of filing of the writ petition.
9. It is then contended that all Assistant Teachers, Junior Basic School (including the petitioners herein) who were appointed by the orders dated 25.11.1999 were promoted to the post of Headmaster, Junior Basic School/Assistant Teacher, Senior Basic School. These promotions were made in two bulk.
10. All teachers who belonged to Scheduled Castes and Scheduled Tribes category were granted promotion on 30.6.2004 while the remaining teachers including the candidates belonging to Other Backward Classes were granted promotion on 27.7.2007.
11. Pursuant to the aforesaid promotion orders, all promotees including the petitioners herein had joined forthwith and started working on the promoted post. There was no dispute with regard to interse seniority of the Assistant Teachers in District Kushinagar at that point of time, since all the persons who were appointed on 25.11.1999 to the posts of Assistant Teachers in Junior Basic Schools were promoted on the same day to the post of Headmasters, Junior Basic School/Assistant Teacher, Senior Basic School (both posts carrying the same pay scale) and further for the fact that the said post is 100% promotional. It is contended that there exist total number of 565 Senior Basic Schools in District Kushinagar and consequently the same number of posts of the Headmaster.
12. The dispute arose when promotion exercise to the post of Headmaster in Senior Basic Schools was undertaken in the year 2015 with the circulation of a provisional seniority list of Headmasters, Junior Basic School/Assistant Teachers, Senior Basic School.
13. It is contended that prior to the year 2015, a provisional seniority list dated 15.7.2010 was circulated by the District Basic Education Officer, Kushinagar. But since the said seniority list did not include the names of teachers appointed on 25.11.1999 and was limited to the appointees uptil the year 1992, there was no question of raising any dispute by the petitioners. No final seniority list was published, thereafter, nor any promotion had been done till the year 2013. Fresh proceeding for promotion was initiated in the year 2013 with the publication of a provisional seniority list which included the names of the petitioners. A copy of the said seniority list is appended as Annexure ‘9’ to the writ petition to assert that the said seniority list referred both the dates of first appointment and joining separately under different columns, but seniority had been fixed from the date of joining of individual candidates. Objections were filed but no final seniority list was published by the District Basic Education Officer. Certain promotions were made to the posts of Headmaster, Senior Basic Schools but since they were limited to the candidates appointed prior to 25.11.1999 as Assistant Teacher, Junior Basic School and no teacher appointed on 25.11.1999 was promoted in the year 2013, there was no question of raising any dispute.
14. It is further contended that the petitioners sought information under Right to Information Act in the year 2013 but the same was not properly replied and copy of district-wise seniority list as demanded by the petitioners was not supplied to them at that point of time.
15. Be that as it may, on 12.6.2015, the District Basic Education Officer, Kushinagar circulated a provisional seniority list of Headmaster, Junior Basic School and Assistant Teacher, Senior Basic School inviting objections against the same. A copy of the list has been appended as Annexure ’14’ to the writ petition.
16. The names of appointees on the post of Assistant Teacher in Junior Basic School on 25.11.1999 (including the petitioners herein) are found in the said list.
17. A perusal of the said list indicates that the date of joining of individual candidates has been treated to be the date of their substantive appointment while determining their interse seniority.
18. The submission is that the petitioners herein had filed objection dated 17.6.2015 against the erroneous determination of interse seniority but without taking any decision on the said objections, without publication of final seniority list, promotion orders dated 31.7.2015 granting promotion to a total number of 437 persons as Headmaster, Senior Basic School, had been issued. The cause of action for filing the present writ petition arose on account of the said action of the respondents.
19. The submission of learned Senior Counsel for the petitioners is that the determination of seniority of candidates under Rule 22 of the Rules, 1981 has to be made from the date of their appointment in a substantive vacancy. As all candidates who were appointed on the post of Assistant Teachers in Junior Basic School on 25.11.1999 were promoted on the same date to the post of Assistant Teacher in Senior Basic School/Headmaster, Junior Basic School, there cannot be any change in their interse seniority, which has to be determined from the date of their initial appointment in service on substantive post. That means interse seniority of all such appointees has to be determined from the date of their initial appointment i.e. 25.11.1999. The entire exercise of promotion in question, therefore, is contrary to the Rules, 1981.
20. These submissions are repelled by Sri Pranesh Dutt Tripathi learned Advocate for the respondent no. 4 from the averments made in the counter affidavit filed on behalf of the District Basic Education Officer.
21. Reference has been made to paragraphs ‘6’ to ‘8’ of the counter affidavit to state that seniority of Assistant Teachers in District Kushinagar had been determined on the basis of date of their joining and based on the said seniority list, promotions were granted to the post of Headmaster, Junior Basic School/Assistant Teacher, Senior Basic School in the years 2004 and 2007, when all the petitioners were also promoted. No objection had been raised by the petitioners against the said seniority list prepared on the basis of date of their joining. In the year 2015, the seniority list of Headmaster, Junior Basic School and Assistant Teacher, Senior Basic School was again circulated in all 14 blocks of District Kushinagar and objections were invited.
22. After decision on all objections, final seniority list was published and, thereafter, 626 Assistant Teachers had been called for counselling held between 11.2.2015 and 14.7.2015. The petitioners herein had also participated in the counselling process. They cannot be allowed to turn around to challenge the seniority list or the promotion orders, once they acquiesced with the fact of interse seniority of the Assistant Teachers in District Kushinagar. All teachers from serial no. 1 to 473 from the said seniority list promoted to the post of Headmaster in Senior Basic School are senior to the petitioners and there is no infirmity in consideration of the date of the joining and date of birth of the respective candidates for the purpose of determination of their interse seniority.
23. As the petitioners did not challenge the promotion exercise conducted in the years 2004 and 2007 and participated in the promotion exercise held in the year 2015, the challenge to the seniority list published in the year 2015 cannot be entertained.
24. Having heard learned counsel for the parties and perused the record, before entering into the controversy at hand, it would be appropriate to go through the scheme of the Rules, 1981, which provides for recruitment, promotion, seniority of Assistant Teachers in Basic Schools run by Basic Education Board.
25. The U.P. Basic Education (Teachers) Service Rules, 1981 (Rules 1981) have been framed by the Governor in exercise of powers under sub-section (1) of Section 19 of the Uttar Pradesh Basic Education Act, 1972 (hereinafter referred to as “the Act, 1972”).
26. The ‘Basic School’ as defined in Rule 2(c) of the Rules, 1981 means a school where instructions from class I to VIII are imparted. ‘Junior Basic School’ as per Rule 2(h) means a Basic School where instructions from Classe I to V are imparted. ‘Nursery School’ as per Rule 2(j) means a school in which children ordinarily of the age up to six years and taught in classes lower than class I. ‘Senior Basic School’ means a Basic School where instructions from Class VI to VIII are imparted. As per Rule 2(o), ‘Teacher’ means a person employed for imparting instructions in Nursery Schools, Basic Schools, Junior Basic Schools, or Senior Basic Schools.
27. Part II of the Rules, 1981 provides for ‘cadre and strength’ of the service.
Rule 4 as contained in Part II of the Rules, 1981 reads as under:-
“4. Strength of the Service. – (1) There shall be separate cadres of service under these rules for each local area.
(2) The strength of the cadre of the teaching staff pertaining to a local area and the number of the posts in the cadre shall be such as may be determined by the Board from time to time with the previous approval of the State Government :
Provided that the appointing authority may leave unfilled or the Board may hold in abeyance and post or class of posts without thereby entitling any person to compensation :
Provided further that the Board may, with the previous approval of the State Government, create from lime to time such number of temporary posts as it may deem fit.”
Rule 5 in Part III of the Rules, 1981 provides for the ‘Source of Recruitment’ and reads as under:-
“5. Sources of recruitment. – The mode of recruitment to the various categories of posts mentioned below shall be as follows :
(a)
(i) Mistresses of Nursery Schools
By direct recruitment as provided in Rules 14 and 15;
(ii) Assistant Masters and Assistant Mistresses of Junior Basic Schools
(b)
(i) Headmistresses of Nursery Schools
By promotion as provided in Rule 18;
(ii) Head Masters and Head Mistresses of Junior Basic Schools
By promotion as provided in Rule 18;
(iii) Assistant Masters of Senior Basic Schools
By promotion as provided in Rule 18;
(iv) Assistant Mistresses of Senior Basic Schools
By promotion as provided in Rule 18;
(v) Head Masters of Senior Basic Schools
By promotion as provided in Rule 18;
(vi) Head Mistresses of Senior Basic Schools
By promotion as provided in Rule 18;
1981) को उत्तर प्रदेश बेसिक शिक्षा अधिनियम, 1972 की धारा 19 की उप धारा (1) के अधीन शक्तियों का प्रयोग करते हुए राज्यपाल द्वारा बनाया गया है। “अधिनियम, 1972”) के रूप में।
26. नियम, 1981 के नियम 2(सी) में परिभाषित ‘बेसिक स्कूल’ का अर्थ है एक ऐसा स्कूल जहां कक्षा 1 से आठवीं तक के निर्देश दिए जाते हैं। नियम 2(ज) के अनुसार ‘जूनियर बेसिक स्कूल’ का अर्थ है एक बेसिक स्कूल जहां कक्षा I से V तक के निर्देश दिए जाते हैं। नियम 2 (जे) के अनुसार ‘नर्सरी स्कूल’ का मतलब एक स्कूल है जिसमें आमतौर पर छह साल तक की उम्र के बच्चे और कक्षा I से नीचे की कक्षाओं में पढ़ाते हैं। ‘सीनियर बेसिक स्कूल’ का मतलब एक बेसिक स्कूल है जहाँ कक्षा छठी से आठवीं तक के निर्देश हैं। प्रदान किए जाते हैं। नियम 2(ओ) के अनुसार, ‘शिक्षक’ का अर्थ नर्सरी स्कूलों, बेसिक स्कूलों, जूनियर बेसिक स्कूलों या सीनियर बेसिक स्कूलों में निर्देश देने के लिए नियोजित व्यक्ति से है।
27. नियम, 1981 के भाग II में सेवा के ‘संवर्ग और संख्या’ का प्रावधान है।
नियम 4 जैसा कि नियमों के भाग II में निहित है,
“4. सेवा की संख्या। – (1) प्रत्येक स्थानीय क्षेत्र के लिए इन नियमों के तहत सेवा के अलग-अलग संवर्ग होंगे। (
2) एक स्थानीय क्षेत्र से संबंधित शिक्षण कर्मचारियों के संवर्ग की संख्या और पदों की संख्या संवर्ग में वह होगा जो बोर्ड द्वारा समय-समय पर राज्य सरकार के पूर्व अनुमोदन से निर्धारित किया जा सकता है:
बशर्ते कि नियुक्ति प्राधिकारी खाली छोड़ सकता है या बोर्ड आस्थगित हो सकता है और पद या पदों की श्रेणी बिना हकदारी के किसी भी व्यक्ति को मुआवजे के लिए:
बशर्ते कि बोर्ड, राज्य सरकार के पूर्व अनुमोदन के साथ, समय-समय पर अस्थायी पदों की इतनी संख्या में अस्थायी पद सृजित कर सकता है, जैसा वह उचित समझे।
नियम, 1981 के भाग III में नियम 5 ‘भर्ती के स्रोत’ के लिए प्रदान करता है और निम्नानुसार पढ़ता है: –
“5. भर्ती के स्रोत। – नीचे उल्लिखित विभिन्न श्रेणियों के पदों पर भर्ती का तरीका निम्नानुसार होगा:
( क)
(i)
नियम 14 एवं 15 में यथा उपबंधित सीधी भर्ती द्वारा
प्रासंगिक रिकॉर्ड। नियम 18(4) के अधीन चयनित अभ्यर्थियों की सूची चयन समिति द्वारा नियम 18 के उपनियम (2) में निर्दिष्ट पात्रता सूची से प्रकट वरिष्ठता क्रम में उसी क्रम में तैयार की जानी है, उसे अग्रेषित करने के लिए नियुक्ति प्राधिकारी।
31. नियम 19 में आगे कहा गया है कि नियुक्ति प्राधिकारी नियम 18 के तहत तैयार की गई सूची में उम्मीदवारों के नाम उसी क्रम में लेकर नियम 5 में निर्दिष्ट पद पर नियुक्ति करेगा। 32. इसका अर्थ है, पारस्परिक
वरिष्ठता चयन समिति द्वारा पदोन्नति के लिए पात्र और उपयुक्त पाए गए उम्मीदवारों की संख्या पदोन्नत पद पर उनकी नियुक्ति पर समान रहेगी।
33. प्रवेश स्तर के पद अर्थात् सहायक अध्यापक, कनिष्ठ बेसिक विद्यालय के पद पर सीधी भर्ती किये गये अभ्यर्थियों की अन्तर्वरीयता उनकी सीधी भर्ती के समय नियम 17 के अनुसार निर्धारित की जाती है।
34. नियम 22 (1) इसके साथ संलग्न परंतुक के साथ आगे कहता है कि एक संवर्ग में शिक्षकों की परस्पर वरिष्ठता उसी क्रम के अनुसार निर्धारित की जानी है जिसमें उनके नाम नियम 17 या 18 में निर्दिष्ट सूची में आते हैं। 35.
केवल उक्त पद के लिए अपवाद नियम 22 के उप-नियम (1) के परंतुक से जुड़े एक ‘नोट’ द्वारा है, जिसमें कहा गया है कि सीधी भर्ती द्वारा चयनित उम्मीदवार अपनी वरिष्ठता खो सकता है, यदि वह नियुक्ति द्वारा दिए गए समय के भीतर शामिल होने में विफल रहता है। बिना किसी वैध कारण के प्राधिकरण।
36. नियम 22 का उपनियम (2) आगे प्रावधान करता है कि एक शिक्षक के अनुरोध पर या उसकी सहमति से एक स्थानीय क्षेत्र से दूसरे स्थानीय क्षेत्र में स्थानांतरण पर उसकी वरिष्ठता समाप्त हो जाएगी।
37. वर्तमान प्रकरण में स्वीकृत स्थिति यह है कि जनपद कुशीनगर के जूनियर बेसिक स्कूल में सहायक अध्यापक के पद पर नियुक्ति हेतु दिनांक 25.11.1999 को कुल 208 अभ्यर्थियों को नियुक्ति पत्र निर्गत किया गया जो कि प्रवेश स्तर का पद है। . उन्हें 15 दिनों का कार्यभार ग्रहण करने का समय दिया गया था और उक्त अवधि के भीतर उन्होंने कार्यभार ग्रहण कर लिया था। रिकॉर्ड पर ऐसा कुछ भी नहीं है जो यह दर्शाता हो कि ऐसे किसी भी उम्मीदवार ने नियुक्ति प्राधिकारी द्वारा प्रदान किए गए कार्यभार ग्रहण समय के भीतर गैर-कार्यग्रहण करने के तथ्य के कारण अपनी वरिष्ठता खो दी थी। इसलिए, नियम 22 के उप-नियम (1) के परंतुक के साथ संलग्न ‘टिप्पणी’ आकर्षित नहीं होती है। उनमें से कोई भी अपनी वरिष्ठता नहीं खोएगा और उनकी परस्पर वरिष्ठता उनकी प्रारंभिक नियुक्ति की तारीख यानी 25.11.1999 से नियम 1981 के नियम 17 के साथ पठित नियम 14 के अनुसार निर्धारित की जानी है। सीनियर बेसिक स्कूल/प्रधानाध्यापक, जूनियर बेसिक स्कूल में सहायक शिक्षक के पद पर प्रोन्नति होने पर स्वीकृत तथ्य यह है कि उन सभी को एक ही तिथि को प्रोन्नत किया गया है, के लिए उनकी अंतर वरिष्ठता अपरिवर्तित रहेगी. उनकी वरिष्ठता का निर्धारण नियम 18(4) के साथ नियम 19 एवं 22 के साथ-साथ जूनियर बेसिक स्कूल में सहायक शिक्षक के पद पर मूल रिक्ति में उनकी प्रारंभिक नियुक्ति की तिथि को ध्यान में रखते हुए किया जाना है, जो ऐसे सभी नियुक्तियों के लिए 25.11.1999 है। .
38. नियमावली, 1981 की योजना के तहत, जैसा कि ऊपर उल्लेख किया गया है, जिला बेसिक शिक्षा अधिकारी के लिए यह खुला नहीं था कि शिक्षकों की वरिष्ठता उनके मूल पद पर उनकी प्रारंभिक नियुक्ति की तारीख के बजाय उनके शामिल होने की तारीख से निर्धारित की जाए। वरिष्ठता निर्धारण में उक्त दोष जिला बेसिक शिक्षा अधिकारी, कुशीनगर द्वारा अपने प्रतिशपथ पत्र में दिये गये कथनों से स्पष्ट होता है। उनका बचाव केवल इतना है कि याचिकाकर्ताओं को उनकी पारस्परिक वरिष्ठता से संबंधित विवाद को हल करने की अनुमति नहीं दी जा सकती है क्योंकि वर्ष 2004 और 2007 में पदोन्नति की गई थी और उन्होंने अभ्यास में भाग लिया था, जिसके परिणाम को चुनौती दी जा रही है। उक्त तर्क पूरी तरह से टिकने योग्य नहीं है।
39. स्पष्ट कारण यह है कि याचिकाकर्ताओं के पास कोई विवाद उठाने का अवसर नहीं था क्योंकि 25.11.1999 को नियुक्त सभी शिक्षकों को जूनियर बेसिक स्कूल में प्रधानाध्यापक और सीनियर बेसिक स्कूल में सहायक शिक्षक के पद पर पदोन्नत किया गया था।
40. इस तथ्य को जिला बेसिक शिक्षा अधिकारी, कुशीनगर एवं निजी उत्तरदाताओं ने भी अपने प्रतिशपथ पत्र में स्वीकार किया है।
41. वास्तव में वर्ष 2015 में याचिकाकर्ताओं एवं निजी प्रतिवादियों की पारस्परिक वरिष्ठता के संबंध में विवाद तब उत्पन्न हुआ जब दिनांक 12.06.2015 को सहायक शिक्षकों की ज्येष्ठता उनके कार्यभार ग्रहण करने की तिथि के स्थान पर उनके कार्यभार ग्रहण करने की तिथि से निर्धारित करते हुए अनंतिम वरिष्ठता सूची प्रकाशित की गयी। प्रारंभिक नियुक्ति। पदोन्नति आदेश की सूचना मिलते ही याचिकाकर्ताओं ने आपत्तियां उठाईं और तत्काल रिट याचिका दायर की। पदोन्नति पाने वालों की तुलना में उनकी वरिष्ठता के गलत निर्धारण को चुनौती देने में याचिकाकर्ताओं की ओर से कोई रोक नहीं है। इसलिए उक्त वरिष्ठता सूची के आधार पर संबंधित पद पर पदोन्नति की पूरी कवायद अवैध है।
42. वर्तमान मामले के तथ्यों एवं परिस्थितियों में यह नहीं कहा जा सकता है कि जिला कुशीनगर के बेसिक विद्यालयों में शिक्षकों की अंतर वरिष्ठता का निर्धारण कर दिया गया है और इसे पुनः नहीं खोला जा सकता है।
43. उक्त चर्चा के लिए दिनांक 31.07.2015 के पदोन्नति आदेश अपास्त किये जाने योग्य है।
44. जिला बेसिक शिक्षा अधिकारी, कुशीनगर को निर्देश दिया जाता है कि नियमावली, 1981 के अनुसार उनकी प्रारंभिक नियुक्ति की तिथि से दिनांक 25.11.1999 को नियुक्त अभ्यर्थियों की परस्पर वरिष्ठता अवधारित कर नवीन वरिष्ठता सूची तैयार करें। ऐसे सभी व्यक्तियों की वरिष्ठता, वरिष्ठ बेसिक विद्यालय, जिला कुशीनगर में प्रधानाध्यापक के पद पर पदोन्नति के लिए उनकी उम्मीदवारी पर नए सिरे से विचार किया जाएगा। तद्नुसार, पदोन्नति के आदेश उनकी वरिष्ठता के निर्धारण के पश्चात् तत्काल जारी एवं कार्यान्वित किये जायेंगे।
45. यह भी निर्देश दिया जाता है कि यदि नई कवायद में याचिकाकर्ताओं को पदोन्नति के लिए पात्र पाया जाता है और 31.7.2015 को पदोन्नति द्वारा भरे गए प्रधानाध्यापक, सीनियर बेसिक स्कूल की रिक्तियों के खिलाफ उनकी वरिष्ठता के अनुसार चयन किया जाता है, तो उन्हें दिया जाएगा। कल्पित पदोन्नति उस तिथि से वास्तविक पदोन्नति आदेश जारी होने तक।
46. आगे यह भी स्पष्ट किया जाता है कि पदोन्नतियों की सूची में फेरबदल और प्रतिवादियों के प्रत्यावर्तन के मामले में, उनसे कोई वसूली नहीं की जाएगी।
47. पूरी कवायद इस आदेश की प्रमाणित प्रति जमा करने की तारीख से दो महीने की अवधि के भीतर पूरी की जाएगी।
48. उपरोक्त टिप्पणियों और निर्देशों के मद्देनजर, रिट याचिका की अनुमति दी जाती है।
